A legal challenge to a law that bans Palestinians from living in Israel with spouses who are Israeli citizens was rejected by a panel of 11 Supreme Court justices. The Citizenship Law is temporary legislation from 2003 which prevents Palestinians who married Israeli-Arabs to receive Israeli citizneship except by special approval from the Minister of the interior for Palestinians who collaborate with Israel. The justices upholding the constitutionality of the law were Eliezer Rivlin, Asher Dan Grunis, Miriam Naor, Elyakim Rubinstein, Hanan Melcer and Neal Hendel. They decided that Israeli citizens have a constitutional right to family life, but this right does not necessarily have to be exercised in Israel. Judge Grunis said that “we have to balance this injury of the right to family life of Israeli citizens against a certain threat, based on past experience, to the life of Israeli citizens.”
