The Israeli government petitioned the High Court of Justice to reconsider its decision to postpone the evacuation, and dismantling, of five structures built on Palestinian land in the Ulpana neighborhood in the Beit El settlement, originally due to take place on May 1. This despite the government’s previous commitment to dismantle the building and its admission that they are built on private Palestinian land. Following the clarification of the situation, the state attorney says in the appeal, and after taking into consideration the “broad, adverse social implications” that the implementation of the decision could have on building in other areas, “it has been decided to rethink priorities on law enforcement in the area.”

Minister of Environmental Protection Gilad Erdan (MK Likud) said in a Kol Israel interview that “evicting the Ulpana neighborhood is a command that is impossible to follow, it won’t be executed”, following the High Court of Justice’s decision to evict the neighborhood until May 1st. Erdan had expressed his support to expropriate the authority of Minister of Defense Ehud Barak (MK Ha’Atzmaut) in matters of settlements. Meanwhile, Barak had said that “we have found 2.2 Hectares in Beit El on which we could build alternative housing if necessary”.

Minister of Strategic Affairs Moshe “Bogie” Yaalon (Likud), said that evacuating the Ulpana neighborhood in the West Bank settlement of Beit El may lead to the dissolution of the government coalition. “We have said that we must not remove the neighborhood,” said Yaalon. “This is a neighborhood of 15 buildings with six apartments in each building, of completely normative people, and all of a sudden they are being told off because a Palestinian claimed the land belongs to him.” The High Court ruled that the state must evacuate the neighborhood by May 1, but Prime Minister Benjamin Netanyahu asked the State Prosecutor’s Office to examine whether a motion could be made to the High Court to further delay the evacuation order.

The state prosecution told the High Court yesterday it would not demolish three structures being built on private Palestinian land in the Beit El settlement by May 2012, due to the IDF’s operational needs in the West Bank. The buildings are being built on private Palestinian land and still uninhabited. In April 2010 the government committed to demolish the buildings within a year.
